What is Mediation?

Independent, professionally trained mediator to help you to work out family arrangements .

Family Mediation is a process designed to resolve family disputes with the help of an independent, trained mediator. This process is particularly beneficial for separating couples dealing with issues related to children, finance, and other family-related matters. The mediator facilitates negotiation, helping to find a solution that works for both parties. 

In most cases of divorce or ending civil partnerships, attending a court hearing is not required. However, where there are issues related to children and finances, the Court will expect the parties to consider mediation before applying to the court to hear their case.

How Much Will it Cost?

Paying For Mediation

We charge £185 + vat for MIAMs per person.

Joint mediation sessions cost £185 + vat per person per hour. We also charge £185 + vat per person per hour for preparing Memorandums of Understanding, and Open Financial Statements.

What to Expect

The family mediation process:

First Call

Mediation usually starts with the mediator having a short initial call with the person who makes the initial enquiry. The purpose of this call is to talk to you briefly about the mediation process.

MIAM

Mediation Information Assessment Meeting (MIAM)

If you do wish to go ahead, we will have a Zoom or MS Teams meeting with you on your own to take details of the background, give you information about mediation, and assess whether your case is suitable for mediation. The MIAMs are confidential and so the content will not be discussed with the other party. If you decide that you do wish to mediate, then we will invite the second person to their own MIAM and repeat the process with them.

Joint Mediation Sessions

Initial Meetings – via Zoom or MS Teams

Following the individual MIAMs, if both parties wish to proceed with mediation, we will arrange a joint mediation session, via Zoom or MS Teams.  In the first meeting, we will go through the Agreement to Mediate, set an agreed agenda, and begin discussions to help you to resolve any disagreements which you may have. 

If the case involves financial issues, we will also begin to formulate an Open Financial Statement with you both. 

Subsequent Meetings – via Zoom or MS Teams

The focus of future joint mediation sessions will depend on the issues the parties want to cover, keeping a close review of the agenda agreed upon in the first session. We can review child arrangements, jointly discuss the provision of financial disclosure, and look further at any proposals made in the first session. Ultimately, the progress of mediation depends on you, but we will help you to reach a conclusion at a speed and in a manner with which you are comfortable.

Agreement is Reached

Once an agreement has been reached, we can record the relevant information and decisions in a number of documents which are: 

  • Open Financial Statement

  • Memorandum of Understanding

  • Parenting Plan

Documents

Open Financial Statement

This records the parties’ financial information as set out in the financial disclosure provided. This is an open rather than without prejudice document, meaning that it can be provided to the court. 

Memorandum of Understanding

This records the discussions in mediation and the overall decisions reached.  This is a without prejudice document and cannot be disclosed in any court proceedings.

Parenting Plan

This records the arrangements for the children and any other matters parents want to document in respect of the day to day care of their children.

Memorandum of Understanding

Make it Legally Binding

Any agreement reached in mediation is not legally binding until the parties have had independent legal advice on it, and not until an agreement has been signed by all parties in open correspondence.  You are able to take independent legal advice from your own solicitor to turn the Memorandum of Understanding into a consent order, which can be lodged at court for approval by a judge.
